Arise Activewear (“we,” “our,” or “us”) operates this website for retail sale of apparel and related products. We reserve the right to update, change, or replace any part of these Terms & Conditions at any time without notice.
Product Information & Availability
We make every effort to display our products and colors accurately. However, variations in screen settings may cause differences. Product availability and pricing are subject to change without notice.
Orders & Payment
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud or error. Payment must be completed at checkout using the available payment methods.
Shipping & Delivery
We currently ship within the United States via USPS or UPS. Processing times are 1–3 business days unless otherwise stated. Once a package is shipped, Arise Activewear is not responsible for delays, lost, or stolen packages. Please contact the carrier directly for delivery issues after shipment.
Returns & Exchanges
For hygienic reasons, returns or exchanges are accepted only for unworn, unwashed items with original tags attached, within 14 days of delivery. Customers are responsible for return shipping costs unless the item arrived damaged or defective. Arise Activewear reserves the right to inspect returned items before issuing refunds or exchanges.
Governing Law & Dispute Resolution
These Terms & Conditions and any disputes arising out of or related to your use of this website or purchases from Arise Activewear shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles.
You agree that any dispute or claim between you and Arise Activewear shall first be attempted to resolve through good faith communication. If unresolved, the dispute shall be submitted to binding arbitration in Bibb County, Georgia, under the rules of the American Arbitration Association (AAA).
You agree that arbitration shall be conducted on an individual basis only and not as part of a class, consolidated, or representative action. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court with jurisdiction.
Nothing in this section shall prevent either party from pursuing a claim in small claims court in Georgia if the claim qualifies.
By using this website or purchasing from Arise Activewear, you expressly waive the right to participate in a class action or jury trial.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining sections shall continue in full force and effect.
